Okanagan Passport Terms of Service

1. Overview

Okanagan Passport (“we”, “us”, “our”) provides a digital platform that allows users to explore trails, collect stamps, participate in experiences, and discover locations throughout the Okanagan region. By accessing or using our Services, you agree to be bound by these Terms.

2. Eligibility

You may use the Services only if you:

• Are at least 13 years old (or the minimum age required in your jurisdiction);
• Have the legal authority to agree to these Terms; and
• Use the Services in compliance with applicable laws and regulations.

3. Your Account

Some features require an account. You agree to provide accurate information, keep your credentials secure, and notify us of any unauthorized use. You are responsible for all activity under your account.

We may suspend or terminate your account if we believe you have violated these Terms or misused the Services.

4. Acceptable Use

You agree not to:

• Use the Services for any unlawful or harmful purpose;
• Interfere with or disrupt the operation or security of the Services;
• Attempt to gain unauthorized access to systems, data, or user accounts;
• Reverse‑engineer, decompile, or modify the Services;
• Upload or share content that is illegal, abusive, or infringes the rights of others.

5. Location Services

The app may request access to your device’s location to show your position on the map, nearby stamps, and relevant trails. You can enable or disable location access at any time in your device settings.

Approximate or precise location data is used only to provide and improve location‑based features and is handled in accordance with our Privacy Policy.

6. Stamps, Badges, and Achievements

Digital stamps, badges, tiers, and achievements earned in the app are virtual items with no monetary value. They cannot be sold, transferred, or exchanged for cash.

We may modify, revoke, or adjust stamps or achievements obtained through misuse, technical issues, or other irregularities.

7. Partner Businesses and Third‑Party Content

The Services may feature partner offers, local businesses, or links to third‑party websites and services. We do not control or guarantee the accuracy, safety, or availability of third‑party content.

Any interactions with partner businesses are solely between you and the business. We are not responsible for any issues arising from such interactions.

8. Purchases and Subscriptions

If the app offers paid features or subscriptions, pricing and terms will be displayed before purchase. Payments are processed through the App Store, Google Play, or other authorized platforms, and their billing and refund policies apply.

We do not store your full payment card details. Any disputes regarding billing should first be directed to the platform where you made the purchase.

9. Intellectual Property

All content and materials in the Services—including branding, graphics, maps, UI elements, text, and software—are owned by Okanagan Passport Inc. or licensed to us.

You may not copy, reproduce, distribute, or create derivative works from our content without our prior written consent.

10. User Content

If you submit content (such as feedback, suggestions, or other materials), you grant us a non‑exclusive, worldwide, royalty‑free license to use, reproduce, and display that content in connection with operating and improving the Services.

You are responsible for ensuring that any content you submit does not violate the rights of others or applicable laws.

11. Wallet Passes

If you add Okanagan Passport passes to Apple Wallet, Google Wallet, or similar services, those passes are issued by Okanagan Passport Inc. and may include contact information for support.

Wallet passes may be updated, limited, or revoked if misused, expired, or if the underlying program changes. Wallet passes do not represent cash or stored value.

12. Service Availability

We strive to keep the Services available and functioning, but we do not guarantee uninterrupted or error‑free operation. Features may change, be added, or removed over time.

You are responsible for ensuring that your device and connection are compatible with the Services.

13. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

We do not guarantee the accuracy of trail data, distances, or partner information, nor do we guarantee that the Services will meet your expectations.

14. Limitation of Liability

To the fullest extent permitted by law, Okanagan Passport Inc. and its affiliates will not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Services.

This includes, without limitation, any injuries, losses, or damages related to outdoor activities, trail use, or interactions with partner businesses. Your use of the Services and participation in outdoor activities is at your own risk.

15. Termination

We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms or engaged in misuse.

You may stop using the Services and request account deletion at any time, subject to our data retention obligations as described in our Privacy Policy.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Continued use of the Services after changes become effective constitutes your acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada, unless otherwise required by the laws of your jurisdiction.
